These Terms and Conditions set out the basis on which Rubbish Removal Highbury provides rubbish removal, waste collection and related services. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming your appointment.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business, landlord, agent or organisation requesting and/or paying for the services.
Services means any rubbish removal, waste collection, clearance, loading, transportation, disposal, recycling or related services provided by us.
Waste means any rubbish, junk, household waste, commercial waste, bulky items, garden waste or other materials that the Customer asks us to collect, subject to restrictions set out in these terms and under applicable waste regulations.
Agreement means the contract between the Customer and Rubbish Removal Highbury for the provision of services, incorporating these Terms and Conditions and any written or verbal confirmation of the booking.
Rubbish Removal Highbury provides waste collection and rubbish removal services, including but not limited to domestic clearances, office clearances, garden waste removal, single-item collections and general rubbish disposal, subject to these Terms and Conditions and applicable law.
We operate primarily within Highbury and surrounding areas. Acceptance of any booking outside our usual operating area is at our discretion. We reserve the right to refuse any service request for operational, safety or legal reasons.
3.1 Bookings may be made by telephone, email or online enquiry form, where available. When making a booking, you will be asked to provide accurate details, including the service address, type and estimated volume of waste, access information, and any special requirements.
3.2 We will provide an estimate or quotation based on the information supplied by you. This may be a guide price subject to confirmation on arrival once we have inspected the waste and assessed access and loading conditions.
3.3 A booking is only confirmed when we have accepted your request, provided a time slot or date, and you have agreed to these Terms and Conditions. We may confirm bookings verbally, by email or in writing.
3.4 You are responsible for ensuring that the information supplied during the booking process is complete and accurate. If the actual waste volume, type or access conditions differ significantly from those described, we may adjust the price, alter the service, or refuse to proceed as set out in these terms.
4.1 You must ensure that we have clear, safe and reasonable access to the waste at the agreed time. This includes arranging any necessary permissions for parking, building access, gate codes or concierge notifications.
4.2 If parking restrictions apply, you are responsible for providing suitable parking or covering any parking fees and, where applicable, congestion or emission zone charges. We may add these costs to your final invoice.
4.3 If access is obstructed, unsafe or significantly more difficult than reasonably anticipated, we may:
a) adjust the price to reflect additional labour or time; or
b) refuse to carry out part or all of the service and charge a call-out or cancellation fee as set out in these terms.
5.1 We collect most household and commercial rubbish, including general waste, bulky items, furniture, appliances, garden waste and similar materials. All collections are undertaken in accordance with current UK waste regulations and duty of care requirements.
5.2 We do not collect certain hazardous or prohibited materials, including but not limited to:
a) asbestos or materials suspected to contain asbestos;
b) chemicals, solvents, oils or flammable substances;
c) clinical or medical waste, syringes or biological materials;
d) pressurised containers, gas bottles or cylinders;
e) tyres, unless specifically agreed in advance; or
f) any other material that we reasonably deem unsafe or unlawful to handle or transport.
5.3 If hazardous or prohibited waste is discovered during collection, we may refuse to remove it and may, at our discretion, suspend or cancel the service. You may be charged for our time and any costs incurred in making the site safe or arranging specialist disposal if you have failed to disclose such materials in advance.
6.1 Prices are generally based on the volume and weight of waste collected, type of materials, access conditions and time on site. We may also take into account any additional labour required, such as dismantling or carrying items over long distances or up multiple flights of stairs.
6.2 Any quotation provided before our arrival is an estimate only, based on information supplied by you. Our team will confirm or revise the price on site once they have inspected the waste. You will be informed of any price change before work begins.
6.3 If you choose not to proceed after we have attended the site and offered a confirmed price, we reserve the right to charge a call-out or cancellation fee to cover our time and costs.
6.4 All prices are stated in pounds sterling and may be subject to VAT or other applicable taxes, which will be clearly identified where charged.
7.1 Payment is due on completion of the service, unless otherwise agreed in writing in advance. We may accept cash, card payments, bank transfer or other methods as advised at the time of booking.
7.2 For business customers, we may, at our discretion, agree credit terms. In such cases, payment must be made within the agreed period from the date of invoice. If payment is not received by the due date, we reserve the right to charge interest on overdue amounts and to recover all reasonable costs of collection.
7.3 We may require a deposit or full prepayment for certain bookings, including large clearances or bookings outside normal operating hours. Any such requirement will be communicated at the time of booking.
7.4 You are responsible for ensuring that all payments are made in full and without set-off, counterclaim or deduction, except where required by law.
8.1 You may cancel or reschedule your booking by contacting us as soon as possible. We request that you provide at least 24 hours notice before the scheduled service time.
8.2 If you cancel or significantly amend a booking with less than 24 hours notice, we may apply a cancellation fee to cover our administration and scheduling costs. If our team has already been dispatched or arrives at the site and we are unable to complete the service due to your cancellation or non-attendance, a call-out charge may apply.
8.3 We will use reasonable endeavours to attend at the agreed time, but all attendance times are estimates only and may be subject to change due to traffic, operational issues or events outside our control. If we need to amend or cancel your booking, we will notify you as soon as reasonably practicable and offer an alternative time or date.
9.1 You warrant that you are either the owner of the waste and the property from which it is collected, or that you have full authority from the owner to arrange the service and dispose of the waste.
9.2 You must ensure that waste designated for collection is clearly separated from items you wish to retain. We do not accept liability for items that are removed in error if they were not adequately segregated or identified.
9.3 You agree not to include any hazardous or prohibited materials in the waste unless expressly agreed in writing. You are responsible for any costs, losses or damages we incur as a result of your failure to comply with this clause.
10.1 Our team will carry out the service with reasonable skill and care, in a professional manner and in accordance with applicable laws and waste regulations.
10.2 We will load and remove waste from the agreed area only. Additional work, such as dismantling fittings or removing fixtures, must be agreed on site and may incur additional charges.
10.3 Once the waste has been loaded onto our vehicle, it becomes our responsibility and we will transport it to an authorised facility for disposal or recycling, in accordance with UK waste legislation.
11.1 Where required, a waste transfer note or similar documentation will be completed to record the transfer of waste from the Customer to Rubbish Removal Highbury.
11.2 We operate under relevant waste carrier regulations and are committed to the lawful and responsible handling of waste. By using our services, you acknowledge your duty of care under UK waste law and agree to cooperate with us in providing any information necessary for proper documentation.
12.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be limited or excluded.
12.2 Subject to the above, our total liability to you arising under or in connection with the Agreement, whether in contract, tort, negligence or otherwise, shall not exceed the total price paid or payable for the specific service giving rise to the claim.
12.3 We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of data, loss of use or any special or punitive damages, whether arising in contract, tort or otherwise.
12.4 You must notify us in writing of any damage or loss that you believe has been caused by our team as soon as reasonably practicable and in any event within 48 hours of completion of the service. We may request evidence, including photographs or access to inspect the alleged damage.
13.1 We maintain appropriate public liability insurance in respect of our operations. Details of our insurance cover are available on request.
13.2 It is your responsibility to ensure that you have any additional insurance you consider necessary in connection with the service or your property.
14.1 We are not liable for any failure to perform, or delay in performing, any of our obligations under the Agreement where such failure or delay is caused by an event beyond our reasonable control. This includes, but is not limited to, severe weather, traffic disruption, accidents, strikes, lockouts, equipment failure, or compliance with any law or government order.
14.2 If an event beyond our control occurs that affects the performance of our obligations, we will contact you as soon as reasonably practicable to arrange a new appointment or alternative solution where possible.
15.1 We aim to provide a reliable and efficient waste removal service. If you are dissatisfied with any aspect of our service, please raise the issue with us as soon as possible so that we can seek to resolve it.
15.2 Complaints should be submitted by telephone or in writing, providing your name, service address, date of service and a clear description of the matter. We will investigate and respond within a reasonable time.
16.1 We will collect and process personal information about you in order to manage your booking, deliver the service, process payments and handle any queries or complaints.
16.2 We will handle your personal information in accordance with applicable data protection laws. Your details will not be sold to third parties, but may be shared with partners or service providers where necessary for the proper performance of the service or as required by law.
17.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect for new bookings from the date they are published or otherwise communicated. The terms in force on the date you make a booking will apply to that booking.
18.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted to the minimum extent necessary. The remaining provisions shall continue in full force and effect.
19.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
19.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our services.
